WHO CAN REQUEST INFORMATION

 

Real and legal persons who are citizens of Turkey have the freedom of information.

Foreign individuals who reside in Turkey have freedom of information only about "themselves", or in the case of foreign corporations, only on matters about “their scope of activities”. They can enjoy this freedom subject to the “reciprocity” condition.  

What are the methods of filing Information Applications?
All applications should be submitted in Turkish. Real and legal persons can submit information application in three ways:

1. With a petition containing the applicant’s name and surname, signature, address of domicile, or business address;

2. Filling in and faxing the "form" available in the “Information Application” section on our website (Turkish) by stating the applicant’s name and surname, signature, address of domicile or business address and the “TR ID Number”;

3. Filling in and e-mailing the "form" available in the “Information Application” section on our website (Turkish) by stating the applicant’s name and surname, signature, address of domicile or business address and the “TR ID Number”;   

How long does it take to answer an Information Application?
All examinations and researches relating to the information application are carried out by the department that will answer the application, and applications are answered in fifteen (15) business days.

However, if the content of the information or document requested concerns more than one entity or institution, access to the information or document will be provided in thirty (30) days.

If the information or document is available with an entity or institution other than ISE, the application petition or form is sent to the information unit of that entity or institution, and the situation is notified to the party concerned.

Note: The term “business day” refers to working days other than Saturday, Monday and official holidays, and these days which are "holidays" are not counted of the answering period.   

Will Access to any Information and Document be charged?
The rates applicable to access to information and documents at ISE have been determined as follows:

  • If the information and documents to which access is permitted are required to be sent as a hard copy, no fee is charged for the first 10 pages including the mail cost.
  • For each page after the first 10 pages 65 kurus and mail cost will be charged.
  • No fees will be charged for information and documents to which access is permitted via electronic mail.
Note: This amount is applicable between 01.01.2009 – 31.12.2009 (Fees are increased in proportion to “Revaluation Rate" at the beginning of each year. See Communiqué of the Ministry of Finance, Series No.1 - Official Journal February 14, 2006” Volume: 26080).  

Breach of Freedom of Information, Liability and Penalty Provisions

In terms of the Applicant:
Information and documents accessed within the framework of the procedures and principles set forth in the Law and this Regulation cannot be multiplied, used, or published for commercial purposes without permission.  Whoever copies, uses or publishes the information or documents accessed in breach of this provision shall be subject to the provisions of the laws governing criminal and legal liability.

In terms of the Party Obliged to Provide Information:
If the application is not answered within the time periods specified in the Law due to the negligence or fault of the officials of the institution, this does not relieve the entity or the institution off its liability to give an answer. - The officials who have any negligence, fault or deliberate action in the execution of the Law and the Regulation will be subject to the disciplinary penalties set forth in the Personnel Regulation of the institution provided that the requirement for a criminal investigation for the committed acts under the general provisions is reserved.
